Terms of Service

These Terms govern the use of the eSurveyor yacht-listing analysis platform at esurveyor.com (“the App”). By accessing or using the App, you agree to these Terms.

1. Description of Service

The App provides automated extraction, structuring, and analysis of used-yacht listings, including specification parsing from listing text and PDFs, fit-score analysis against your dream-boat profile, Component Health Index estimates, marketability scoring, Total Cost of Ownership (“TCO”) modeling, broker question pack generation, side-by-side comparison of prospects, and deal pipeline tracking.

These features are decision-support tools, not professional marine survey, broker, legal, or financial advice.

2. User Responsibility & Buyer Warning

The prospective buyer remains solely and fully responsible for all purchase decisions.

• The App is not a substitute for a licensed marine surveyor (SAMS or NAMS accredited).
• The App is not a substitute for a sea trial of the specific vessel.
• The App is not a substitute for a licensed yacht broker, maritime attorney, or title-search professional.
• AI-generated analysis can be wrong, including in material ways. You must verify all material information with the broker, seller, and your retained professionals before making any commitment to purchase.

Assumption of Risk: Use of the App in connection with any purchase decision is done entirely at your own risk.

3. Accounts & Security

You agree to provide accurate information and maintain the security of your login credentials. You are responsible for all activity under your account. We reserve the right to suspend accounts for abuse, automated scraping, sharing of login credentials, or violation of these Terms.

4. Pricing & Billing

The App is currently provided free of charge. If paid plans or premium features are introduced in the future, payment terms (including billing cadence, refund policy, and cancellation procedures) will be presented before any charge is incurred and will form an addendum to these Terms.

5. Acceptable Use

You agree not to:

• Reverse engineer the platform, its parsers, or its analytical models
• Interfere with our servers or attempt to access data belonging to other users
• Scrape, replicate, or systematically extract data from the App at scale
• Use the App to send unsolicited communications to brokers, sellers, or other parties beyond the purpose of legitimately evaluating a listing
• Use the App in furtherance of any fraudulent transaction
• Upload listing text or PDFs that you do not have the right to use

Commercial redistribution of the App’s analytical output (fit scores, broker question packs, TCO models, marketability bands) is prohibited without written consent.

6. Intellectual Property

All software, proprietary algorithms, parsers, prompt templates, and design within the App are the intellectual property of eSurveyor. Users are granted a limited, non-transferable, non-exclusive license to use the App for personal yacht-buying research.

User-generated content (your imported listings, dream-boat profiles, notes) remains your property; you grant us a limited license to store, process, and display it solely to operate the service for you.

7. Limitation of Liability

To the fullest extent permitted by law, eSurveyor and its operators shall not be liable for any damages — direct, indirect, consequential, incidental, or maritime — arising from the use of this service. This includes, but is not limited to: purchase decisions made in reliance on App analysis, post-purchase defects, undisclosed liens or title problems, missed market opportunities, broker disputes, vessel damage, personal injury, or financial loss.

In any case, the total aggregate liability of eSurveyor under these Terms shall not exceed (a) the amount you have paid us in the twelve months preceding the claim, or (b) one hundred US dollars ($100), whichever is greater.

8. Service Availability & Data Sources

The App relies on external AI processing providers, hosting infrastructure, and email-delivery services. We do not guarantee 100% uptime or the absolute accuracy of any AI-generated analysis. Maintenance windows may occur without notice.

9. Termination

We reserve the right to terminate or suspend accounts that violate these Terms. Users may terminate their account at any time by emailing support@esurveyor.com.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator is registered, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be brought exclusively in the courts of that jurisdiction.

11. Disclaimer Incorporated by Reference

The eSurveyor Disclaimer is incorporated into these Terms by reference. Use of the App constitutes acceptance of both these Terms and the Disclaimer.

12. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or in-app notice. Your continued use of the App after an update constitutes acceptance of the new Terms.
